Mmm....thats an interesting point.
I'm not 100% sure about the situation,but it might be worth a phone call to your local dealer and,without mentioning the Cat D problem,see if they would carry out the repair on warranty.I would definately give it ago.....the worst that can happen is that they can say no.They might realise the car has been damaged either from their computer system or the reason for the fault on your car,but as I said it's definately worth a try.
Have you had the car inspected to make sure the body repairs are to a good standard and safe?.
I'd rather push my Alfa than drive a BMW....
