I think the seller would either have to be a named executor of a will and able to send proof of such to the DVLA with the log book when sold, or if they have been bequethed the car then they should have proof of this.
Don't forget the Registered Keeper on the V5 does not have to be the Legal Owner.
These situations are messy though. At least the reason sounds easier to deal with than someone selling for a friend who has 'gone abroad' etc
