As the publisher, OG is responsible for the comments on the forum. As such, any sniff of legal action by anybody named and shamed on the forum, and we'd be forced to shut it down...

But more seriously, I inadvertently put myself in this position a few years ago, trying to protect members of an MSN group from a 'very nice' individual who I knew to have been investigated for some very unsavoury activities. A couple of good on-line friends of mine had already been hurt through getting involved with the guy, and I knew he had to be stopped. He refused to go quietly, so I 'named and shamed' to protect other members of the group, and was threatened with libel proceedings for my trouble. I was lucky that the individual concerned never took it further, because as it happens the UK libel laws leave you guilty until proven innocent. The 'libelled' party has twelve months to make a case, so I'm in the clear now, but it was a pretty fraught time for me and those around me.

Your dealer sounds as bad as mine, but as I already have to drive a round trip of 80 miles to get there I don,t have any other options. The next nearest is a round trip of 110 miles!

I think it is even easier to get a complaint dealt with if you send a letter is on the back of the MOT failure page...the relevant government standards office. They MUST investigate and let you know what happens.

Even if the dealer worms his way out of this one, if a certain amount of complaints are made ( think it is 3 in a year ) then he is at huge risk of losing his license, as the bureaucrats will find it hard to give him the benefit of the doubt.

So even if you are fobbed off, your complaint will be held on record and so it does make a difference.

Sounds amazing to me that a car should fail its emissions on the third MOT. If it was going that way, why not year 2?

Or, as you no doubt suspect, why fail at all....which it didn't, just hours after in the other test.

If this dealer is a deliberate rip-off, we ALL need him off the license books. ( The fact that you can show a failed test and subsequent pass will get even the most naive bureaucrat to frown )
