Unhappy Any advice on where I stand?

This issue is driving me nuts.

My girl and I have recently bought a 2006 Audi A3 from a small used car trader, I hate to say it but with no warranty. On our way home from collecting the car we found that although the radio worked the CD player didn't, we called the seller straight away and sought a repair.

The trader asked us to have a diagnostic carried out, I was dubious that this would tell us more than what we already knew but I contacted the local Audi dealership for a quote, which on hearing our seller decided not to proceed with.

After some phaffing by the trader he came back to us wanting to fit an aftermarket unit, we could pick it but no more than 130. Having paid 12000 for the car we said we wanted an Audi unit.

The Audi dealership said that they don' t repair the CD player, they offer an approved Audi exchange part, a reconditioned unit at about 230 + 100 labour + our broken unit as long as its not been tampered (add 230 if it has).

Our trader asked if he could have a week to try to find it cheaper so we agreed; now we haven't been able to elicit a response from phone calls, emails or letters for 4 months until today. He says he has taken legal advice and doesn't owe us anything but as a good will gesture he's offered us 100.

Where do I stand? Is it worth getting the work done and pursuing the trader for the cost?

In my experience when a Trader or proffesional offers you a goodwill gesture he/she is hedging their bets. If you paid 12.000 big ones the radio/cd should be working.

Contact the trading standards and also if you financed the car contact your lender, they are as obliged to you as the dealer that sold you the car. Keep a record of all the dates and times that you have tried to contact him. Your consumer rights indicate that you have 90 days to return the car and get a refund. It's probably not a coincidence that the dealer has been on the missing list for three months!!

Have a look at this

What I was trying to find was i think that all dealers now have to give a 3 month warranty but havnt found it

The older I get the better I was, must be mad not got enough money to be excentric

If you bought from a business rather than a private seller, then you should have recourse through The Sale of Goods Act. If a fault arises within the first 6 months of ownership, it is deemed to have been present at time of purchase unless the seller is able to prove otherwise. The act applies to second-hand goods too, as long as they were bought from a business rather than a private seller.

The 4 month delay troubles me. It sounds like deliberate stalling tactics, and if you've now had the car for more than 6 months, it may be up to you to prove that it was faulty at time of purchase. Hopefully, the Audi dealer that you made enquiries to would be prepared to back you up on this.

In your shoes, I'd accept either an official Audi unit or a third-party replacement that is superior to the factory fit one. It strikes me as a fair trade to have a non-Audi unit if you end up with a better system as a result. If his best offer is 100 quid, then I'd see him in court.
