In most cases you'll find that part-worn tyres whilst still legal have been rejected due to the recommended (not the legal limit) wear limits in some European countries.

What concerns me is not just the treads but also the overall quality of the tyre such as the walls and inner reinforcement as there is no way of testing that aspect. Many used tyre sellers state the tyres have been pressure tested but so have condoms.

Personally I would never fit or uses part-worn tyres.
I don't know what your car insurer would say but I doubt they would be happy.
