I was actually playing with mine yesterday. If it's in gear you shouldn't be able to start the car without pressing the clutch.
If you've got it in gear but the clutch is completely dressed it shouldn't release, only once you start moving the clutch out should it release.

I wish the Laguna MK2 had an auto hold system on hills. I love the fact it engages and disengages automatically and I can honestly say I've never had an issue with my handbrake.

Incidentally I test drove the new Fiat 500X which has an electronic handbrake and it was scary. When you turned the ignition off it's nearly 2 seconds before the handbrake engages (this isn't a fault either it's the automatic setting) I also found that loads of times it didn't disengage and I was trying to pull away with it engaged!
