Second-hand cars don't have to be free of faults. A faulty gearbox is a very different thing from rusty brake pads.
You are right on that but cars from dealers have to be fit for purpose.
Safety items like brakes fall full square into this.
Dealers can avoid by listing known faults, even listing as "spares or repair" but if sold as a runner, the question comes down to was the failure due to fair wear and tear or a fault when sold.
Timing is key in those sort of discussions.
If the motor was bought last week, easy win.
If three months ago, less certain as use, mileage, possibly bodged repairs can all come into play.
