Are the brakes just squeaking? If so then it may not mean that the brakes are worn.
If the sound is more of a grinding then it is more likely that the pads are worn.
A squeak could mean that the brake pad retaining spring may be loose, worn or broken. It could mean that the pads just need to be removed and a very small amount of grease put on the back of them and put back together.
None of the above will come into an MOT.
If the pads are worn then the car should not have passed it's MOT or at the very least you should have been given an advisory notice.
