Is the bar a load bearing member though?.It is of course with in 30cm of a suspension mounting,but does it add to the strength of the area around that mounting?.
I never did ask VOSA about this when I was testing,but I'm sure your local office will be able to answer the question for sure.It is one of the grey areas of the test,if a Megane or Scenic was presented for a test without the brace then would it pass?.Of course it would,so really it shouldn't fail if the item is corroded,but looking at it the other way,if it is fitted and it is badly corroded,then it should fail......but does the fact that it is corroded make the vehicle unsafe to use.....well....no.
i would it say it is not load bearing as when i fitted my bar i did not need to support anything with a jack or axle stands
it is not a torsion bar either as it is not under tension
i ran my car for a week without the bar fitted and it did not seem to affect the cars performance
