I think it depends on where you go, and how the ruleing is interprited, where I work they work on a basic mind set, if it has it and it doesn't work it fails. in other words if it has a spare wheel which is bold - Failed, but if it has no spare wheel - pass, if the rear door of a 4 door does not work - fail same as 3 door folding seats, if one does not work - fail, as it seems to fall into quite a grey area with VOSA and will depend on the VOSA chap who may be waiting out side to stop and check the vehicle, most garages will now play safe as the fines and the simple revenue loss of a frozen MOT facility is massive these days, Also by VOSA ruling an MOT MUST take 1 hour to do, this they do not move on, so one MOT ramp with one MOT tester can only do 8 MOT's in an 8 hour day, if that ramp and tester are doing 9 MOts in the 8 hours VOSA will want to know why? how do they know, well you are not allowed to log off that MOT for that vehicle in less than 1 hour all information is now sent live to VOSA as it happens, so they inturn can send the information direct to thier roadside examiners which can in theory stop and check the finished test at the road side on that day, it ocasionally happens with us, they also come on site within minuites of us logging off a test and look directlly for that vehicle on the premises, again only occasionally, but it happens!
