I think the view is that if a vehicle is fitted with a safety device then it should at least be in working condition. Not unlike the difference between vehicles that have or haven't ABS for instance.
And as MOT testers are not permitted to remove or interfere with any apsect of the car during testing thay have only warning signs to rely on.
