Unhappy 05 Grand Scenic Electric handbrake problem - help !

For some reason, on the drivers side of the car, the handbrake is not applied when put on. I noticed an issue a few days ago when I was applying/releasing the handbrake that the car was rocking slightly from side to side. My husband has jacked the car up and has found that when the handbrake is on, the drivers side rear wheel is free moving. Can anyone please advise if this is fixable or if a whole new unit is required ? Also, is this likely to be covered in a warranty for the car ? My 2 year warranty ends on Thursday this week !
