Mine seems to be the same, but if I am holding at 30mph and flick the trip button it gives me the average speed of 31.2 mph, think it depends if its uphill or downhill. Don't know what the criteria is in England but in Scotland, the Procurator Fiscal (CPS Equivalent) won't prosecute unless it's higher than that. Don't want to post the speed they prosecute at but lets just say you have a couple of miles per hour to play with. It's the same offence whether in Scotland or England so I would assume the same parameters apply.
