You certainly have a reasonable legal position. It doesn't matter that the warranty period has now expired, the garage have failed to fix an issue reported within the warranty period, though the longer you leave it the weaker your position will become.
It could be that the new engine has just been swapped and not properly reprogrammed. Renaults require more programming than most makes and it can only be done properly with a genuine Renault CLiP device.
On the other hand the engine the dealer sourced could be knackered.
I would certainly go back to TS asap.
