You are guilty of the offence and have no grounds to appeal...all mobile phones in a car have to be mounted on a dash/windscreen holder and must be used on 'hands-free' at all times. Holding the phone is signalling your intention to either make or receive a call or to send/read a text, or even to watch a video, hence you are not in full control of your vehicle, or have full attention on your driving.
In future you'll either have to turn your speaker up or buy an amplified speaker kit.
