I've read a few different threads on the subject but still stuck.

The brake lights are on both with the other lights on and off. So suspected the brake switch, once found on the passenger side???
I removed it out to check it wasn't sticking lights still on
Disconnected it lights still on

Does this sound like a failed switch or a wiring issue or something else?

If its the car I am thinking of, if you open the tailgate, at the top of the opening will be either one or two rubber gaiters that the wiring runs through, as these are bent and stretched every time the boot is opened and closed sometimes the wires rub against each other inside and cause a short, I would pull the car side end off the rubber boot(s) out and have a close look at each of the conducters inside to see if any of the insulation has worn through
